Scratches...Disc Unreadable Errors

My 360 has scratched about a half dozen games. I get them resurfaced and they are fine. I reported this to MS and I got the "this only happens when you move it...." speech. It hasn't been moved, and it happens vertical or horizontal. I can't find anything on here, but the place i got them resurfaced said they're seing lots of 360 games with this problem. Is this a hard drive problem, or something else. Any ideas would be appreciated. I'm really at a loss here. I was really upset when they wouldn't do anything about it under my warranty period. They kept "troubleshooting' it over the phone until my warranty was up. Then they would have been more than happy to take my $139.30.

First suggestion...By those rubber disc protectors that you put around the outside edge of the disc. It seems to do wonders. At least for me it has. I had the same issue a few times, but once I bought those I havent had a problem since.

Second suggestion...Ask for a supervisor and raise hell on the phone when you call Xbox.com. Those reps, who dont work for MS, are programmed to come to a solution the quickest way they can that doesnt result in MS losing money. Raise enough hell on the phone, and they'll quickly change their tune.

In the lawsuit, the Plaintiff is asking the Court to certify a nationwide class and create a fund for all individuals that have had discs damaged by an Xbox 360. The Plaintiff has alleged that the total minimum amount of damages incurred by all of the individuals combined is at least $5,000,000.00. To be clear, the Plaintiff is not alleging that he or any individual member of the class is entitled to that amount of money. The sum recovered by individual class members will be significantly less than the total damages incurred by the proposed class as a whole.
