Microsoft sued over Xbox outage

Microsoft now faces a lawsuit over recent problems with its Xbox Live online gaming service.

Three Texas residents filed a lawsuit Friday on behalf of themselves and others who have had trouble connecting to Xbox Live in recent weeks.

The suit, filed in U.S. District Court in Houston, claims Microsoft's outages represent a breach of contract and negligent misrepresentation for which the software maker is liable. The suit doesn't claim specific damages, but notes the amount is in excess of $5 million.

In the suit, the plaintiffs allege that Microsoft should have known strong holiday sales would tax its servers. "Microsoft knew the increase in subscriptions would increase game-play on its servers, yet failed to provide adequate access and service to Xbox Live and its subscribers."

Microsoft has apologized for the outage and said it would allow Xbox live subscribers to download a free game.

A Microsoft representative was not immediately available for comment.

Not only will this be looked upon as frivolous law suit the people suing look like idiots, honestly now I don't think ps3's servers are doing so great either last I heard they can't even get online. They say they had a breach of contract that because they couldn't connect for such and such long they're entitled to 5 million dollars... But I'm pretty sure almost everyone here have been connecting fine, I have...

Live was down for many of us intermittently over th holidays. I think the longest it was down here was like 10-18 hours at one time. Anyhow, these lawsuits just crack me up and it shows how money hungry our society is. When I see these all I can think about is the lady that spilled coffee on her lap and sued McDonalds because it was too hot. AND WON!!!! These people need to be put in front of a firing squad and shot.

These people need to be put in front of a firing squad and shot.

Wait... What? Some lady spilled coffee on her own lap... Sued, and won? How the hell does that happen? Gah, I swear I need to move to somewhere new like france or... Canada, or something.

Nope not in Canada. very hard to sue here. My Grandmother went to a doctor and the doctors neglegence led to my grandmother losing her bladder to cancer.

The doctor didn't send in lab tests because it would have cost her $5. My grandmother kept complaining of symptoms for months and months.

Anothing thing that in my province, everyone's car insurance is "no fault insurance". Basically you can't sue the other driver.

Lawsuits just don't happen here like they do in the states and the amounts awarded are substantially less.

Hmm well people get cranky over the dumbest things.. then again downloading a free game is nice of MS for the pain the but Live was.. MS always does the right thing in the end..

Takes them long enough, and alot of complaints before they do the right thing though.

As for the coffee thing. Thats why you see HOT printed all over th cups now. Other manufacturers have followed that lead and put idiot proof warnings on products to avoid suit as well. Some folks just dont have common sense. I always thought coffee was hot (before ice coffee came along), and never thought twice about it. The lady was awarded well over a million dollars I believe.

I wonder if we get to download a free game? And if so what game.. Cuz I wanna download a free xbox game off the marketplace.

I will admit though that was a rough couple days of playing with all those hiccups on COD4..

I'd sue my mom for making me clean my room and yelling, I see that in the States more, that everyone sues someone else for some retarded reason.

Women get away with all kinds of crap these days.

This one however will never go through, because the wrong gender is suing.

I hate to say it but due to our misandric justice system women have a chance to win any kind of frivolous lawsuit.

Look at all of the politically correct lawsuits against employers by female employees. Even pre-nuptials don't matter anymore if the woman wants to take half she can just cry abuse and chivalry gets her a win.

So since these three people are males the lawsuit may fail. Maybe they should have got their "girlfriends" to sue MS? :)

and while she was quite stupid to spill the coffee, she did have 3rd degree burns over 6% of her body and lesser burns over 16% (she had to have skin grafts)

Those burns were due to her own stupidity and regardless of the degree she shouldnt have the right to sue. Coffee is hot, simple as that. But thats the way of our pathetic justice system. Let the criminals go, and let people win lawsuits for issues resulting in their own negligence.
