Okay, let's get back to the question at hand. Your disc is damaged. That alone will have Microsoft laugh at you.
The only way that you could get reimbursement for a damaged disc is if a Microsoft component (in this case, the Xbox itself) caused the damage.
You dropping it, running scissors over it, losing it, etc is neither the fault nor the problem of Microsoft or the designer. In other words, the responsiblity of it is yours.

As of this moment, it is ILLEGAL for you to break the copy protection and make a backup of your Xbox games.
Period.

when would it be legal to break the protection and copy the games? of course its illegal, and it will always be illegal.

Games are almost exactly the same price in Canada as in the US(once you do a currency conversion) $50 US = about $79 CDN. I have seen any games that cost 90.00 in Canada, most are $70 - $80 and some are even in the 60s, so some games are CHEAPER in Canada.
